1. Introduction
These Terms and Conditions ("Terms") govern your use of our video review service ("Service"), where you pay a fee for us to review and provide feedback on your riding videos ("Video(s)"). By using our Service, you agree to these Terms. Please read them carefully.
2. Service Overview
We provide a video review service where you submit videos of your riding activities, and our team reviews the video to provide feedback, tips, and suggestions for improvement. This service is paid, and the fees for the Service are listed on our website.
3. Eligibility
To use our Service, you must be at least [18] years of age or have the consent of a legal guardian. By submitting a video for review, you represent and warrant that you are eligible to use this Service.
4. Submitting Videos
- Videos must be submitted in .mp4, .mov] and be no larger than 10Mb.
- Videos should not contain any content that is illegal, harmful, offensive, or violates intellectual property rights.
- You are responsible for ensuring that the videos you submit do not infringe any third-party rights, including copyright or trademark rights.
5. Fees and Payment
- Our Service is a paid service, and the pricing is outlined on our website. By submitting your video, you agree to pay the applicable fee.
- Payments are processed through PayPal and you must provide valid payment information.
- Fees are non-refundable once the video review has been completed, except in cases of technical issues or failure to deliver the promised service.
- All fees are in AUD (Australian Dollars), and you are responsible for any additional taxes or charges that may apply to your transaction.
6. Video Review Process
- Once your payment has been processed, we will begin the review process. We aim to provide feedback on your video within 5-7 business days.
- The feedback provided will include suggestions, techniques, and recommendations related to the riding skills.
- The review is subjective, and while we strive to provide helpful advice, we do not guarantee specific improvements in performance or results.
7. Intellectual Property
- You retain all rights to the videos you submit, including copyright. However, by submitting a video for review, you grant us a limited, non-exclusive, royalty-free license to use the video solely for the purpose of providing feedback.
- We reserve the right to use excerpts of the video (with your permission) in promotional materials, such as website examples, marketing campaigns, or social media posts, if agreed upon in advance.
- You represent and warrant that you have all necessary rights to the video, and that it does not infringe on the intellectual property rights of any third party.
8. Privacy and Data Protection
- We take your privacy seriously. Any personal information you provide will be handled in accordance with our Privacy Policy.
- Your video content will be stored securely and only used for the purposes outlined in these Terms. We will not share your personal information or video content with third parties without your consent, except as required by law.
- We comply with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth), which governs the collection, storage, and use of your personal information.
9. Limitation of Liability
- Our Service is provided "as is" and without warranties of any kind, either express or implied. We do not guarantee that the video review will improve your riding skills or that the feedback will be free from errors or omissions.
- To the fullest extent permitted by law, including under the Australian Consumer Law (ACL), we limit our liability to the amount you paid for the service. We are not liable for any indirect, consequential, or punitive damages resulting from the use of the Service or the feedback provided.
- Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law (ACL), including guarantees of acceptable quality and fitness for purpose.
10. Consumer Rights under Australian Consumer Law
- As a consumer, you are entitled to certain rights under the Australian Consumer Law (ACL), including a right to a remedy (such as a refund, repair, or replacement) if the service we provide fails to meet a consumer guarantee.
- If the Service is not of acceptable quality or is not as described, you may be entitled to a remedy under the ACL. Please contact us if you believe you are entitled to a remedy.
11. Cancellation and Refunds
- You may cancel your order and request a refund within 24-48 hours of submission if the review process has not yet started. Refunds will not be issued once the review is completed.
- We reserve the right to refuse or cancel orders at our discretion, including in cases of suspected fraud, violation of these Terms, or inappropriate content.
- Refunds will be processed in accordance with the Australian Consumer Law if the service does not meet the required guarantees or is defective.
